Lucknow doctor accused of rape and forcible conversion held

LUCKNOW: Lucknow police on Friday arrested the resident doctor of King George’s Medical University (KGMU) accused of repeatedly raping a junior colleague on the false promise of marriage, forcing her to undergo an abortion, and coercing her into religious conversion. Rameezuddin alias Rameez (31) was nabbed near the city station by a joint team comprising cops from West Lucknow surveillance unit and Chowk police station. Earlier in the day, KGMU recommended his termination after its internal complaints committee found him guilty of emotional, mental and physical harassment of the complainant. Addressing a press conference, vice-chancellor Soniya Nityanand said based on its findings, the university forwarded its recommendation to Directorate General of Medical Education for further action. “This is the highest level of action a university can take on the grounds of indiscipline,” the VC said, adding that the doctor was suspended on Dec 22, and his entry to KGMU campus was banned with immediate effect. Rameezuddin, who is from Pilibhit district, had been on the run since he was booked on Dec 23 following a police complaint filed by the survivor, DCP Vishwajeet Srivastava said. Based on the complaint, an FIR was registered for rape, causing miscarriage and marriage by deceit, under sections of BNS and UP Prohibition of Unlawful Religious Conversion Act, 2021. Panel probes conversion allegations: A seven-member fact-finding committee of KGMU, chaired by professor K K Singh, is probing allegations of forced conversion attempts and extremist activities on the campus, and will submit its report in 10 days. SC asks Centre to introduce Romeo-Juliet clause in POCSO to save genuine teen relationships | India News

SC asks Centre to introduce Romeo-Juliet clause in POCSO to save genuine teen relationships

NEW DELHI: Taking note of the rampant misuse of the Protection of Children from Sexual Offences Act, the Supreme Court on Friday asked the Centre to curb the menace by introducing a “Romeo-Juliet” clause to exempt “genuine adolescent relationships” from its stringent provisions. In a significant verdict, the top court also held that the high courts cannot order mandatory medical age determination of victims at the stage of bail in cases under the Protection of Children from Sexual Offences (POCSO) Act.A bench comprising Justices Sanjay Karol and N Kotiswar Singh said, “Considering that repeated judicial notice has been taken of the misuse of these laws, let a copy of this judgment be circulated to the Secretary, Law, Government of India, to consider initiation of steps as may be possible to curb this menace inter alia, the introduction of a Romeo-Juliet clause exempting genuine adolescent relationships from the stronghold of this law; enacting a mechanism enabling the prosecution of those persons who, by the use of these laws, seek to settle scores, etc.The bench, however, termed the law the “most solemn articulations of justice aimed at protecting the children of today and the leaders of tomorrow”.Setting aside an Allahabad High Court order to this effect, it held that the high court’s direction of medical age determination of victims at the stage of bail exceeded the jurisdiction under Section 439 (grant of bail) of the Code of Criminal Procedure (CrPC).The bench ruled that the high courts cannot use their bail jurisdiction to conduct “mini-trials” or issue mandatory investigative protocols that contradict existing laws.“The determination of the victim’s age is a matter for trial, and the presumption which is accorded to the documents enumerated under the Section has to be rebutted there, for that is the appropriate forum to do so, not the bail court,” it held. The case stems from a challenge by the Uttar Pradesh government against an Allahabad High Court order granting bail to an accused in a sexual assault case, apparently involving a minor girl. While granting bail, the high court issued a slew of directions, including that in every case under the POCSO Act, police must conduct a medical age-determination test at the outset. The top court, which set aside the high court judgement, however, left the part of the order granting bail as “undisturbed”.The verdict, authored by Justice Karol, faced the question of whether the high court, while dealing with bail pleas, could have issued directions mandating an age-determination test to be conducted in all cases involving the POCSO Act.“It is unquestionable that the high court is a constitutional court. However, in the instant case, the error of jurisdiction by the high court was in exercise of a statutory power and not under the Constitution…,” it said.“There is an additional aspect which, if the proposition as posited by the impugned judgment is upheld, would fall foul of. Such an aspect would be that a court, at the stage of bail, cannot conduct a mini-trial. This position is trite in law,” it added.Referring to judgements, it has been clearly held that the determination of the victim’s age is a matter of trial and not at the stage of bail.“If the age is under question, the bail court may examine the documents produced to establish age, but it will not enter into the question of those documents being correct or not so…,” it said.“In cases where the victim’s courage may be tested by stigma, shame or the weight of societal scrutiny, medical evidence provides an impartial testament, grounding the pursuit of justice in the certainty of observable fact. It is, in essence, the bridge that links the personal suffering of the victim with the impartial adjudication of the law,” the bench said.It referred to certain instances of the high courts, noting the misuse of the POCSO Act.“Yet, when an instrument of such noble and one may even say basic good intent is misused, misapplied and used as a tool for exacting revenge, the notion of justice itself teeters on the edge of inversion. Courts have, in many cases, sounded an alarm regarding this situation,” it said. The misuse of the POCSO Act highlights a grim societal chasm – on the one end children are silenced by fear and their families are constrained by poverty or stigma, meaning thereby that justice remains distant and uncertain, and on the other hand, those equipped with privilege, literacy, social and monetary capital can manipulate the law to their advantage, it said. The bench directed the registrar (judicial) to share a copy of the judgment with the registrar general of the Allahabad High Court for necessary follow-up action, as well as information to the trial courts. The bench also emphasised the ethical responsibility of lawyers to act as gatekeepers against frivolous or vindictive litigation, warning that unchecked misuse erodes public faith in the justice system.

Narco crackdown: Amit Shah chairs NCORD meet; calls for coordinated national push against drug trafficking
Amit Shah chairs NCORD meet

NEW DELHI: Union home minister Amit Shah on Friday chaired the ninth apex-level meeting of the Narco-Coordination Centre (NCORD) in New Delhi, reviewing India’s strategy to tackle drug trafficking and substance abuse.During the meeting, Shah said the government plans to launch a nationwide campaign against drugs from March 31, 2026, for a period of three years. He said the initiative would involve action on multiple fronts and aim to accelerate efforts towards making India drug-free.Shah said all central government departments should prepare a roadmap extending up to 2029, along with a monitoring mechanism, to address the drug problem in a comprehensive manner. He described the drug challenge as being closely linked to narco-terrorism rather than a routine law-and-order issue, calling it a threat to the country’s future generations. He noted that drug abuse affects the health, thinking ability and performance of young people, and contributes to social unrest. Stressing the importance of public outreach, Shah said sustained awareness efforts were essential to prevent drug use.According to the home minister, the government’s approach rests on three pillars: strict action to disrupt drug supply chains, strategic measures to reduce demand, and a humane response to address harm among users. He said there should be no leniency towards those involved in manufacturing and selling drugs, while individuals who have begun using drugs should be dealt with sensitively.Shah emphasised the need to strengthen command, compliance and accountability, adding that the focus should be on outcomes and impact rather than the number of meetings held. He said action against kingpins, financiers and logistics networks of the drug trade should be regularly reviewed, along with efforts to improve conviction rates through the use of FSL and timely filing of charge sheetsHe also flagged changes in drug distribution and payment methods, calling for strategies to be updated from time to time. Shah said state police forces would form permanent teams in mission mode, with greater use of intelligence inputs and artificial intelligence. The home minister also inaugurated the Narcotics Control Bureau’s Amritsar office.

BJP Targets Mamata Banerjee Over ED Raid At I-PAC, Alleges Evidence Tampering

“Yesterday, officials from the Enforcement Directorate carried out searches at the I-PAC office and at the residence of our Director, Pratik Jain, in Kolkata. It was difficult and unfortunate day for a professional organisation like I-PAC. We believe this raises serious concerns and sets an unsettling precedent. Regardless, we have extended full cooperation and will continue to do so as required, engaging with the process in complete accordance and respect for the law,” the statement said.“Over the years, I-PAC has worked in a professional advisory capacity with multiple political parties across ideologies and regions, including the Bharatiya Janata Party, Indian National Congress, Aam Aadmi Party, All India Trinamool Congress, Dravida Munnetra Kazhagam, YSR Congress Party, Telangana Rashtra Samithi (now BRS), Janata Dal (United), Shiv Sena among others. We do not contest elections or hold political office. Our role is limited to transparent and professional political consulting, uninfluenced by differences in political ideology,” it further said.High drama unfolded after the ED carried out searches at the Salt Lake office of political consultancy firm I-PAC and the Kolkata residence of its founder Pratik Jain, along with other locations in West Bengal and Delhi, in connection with a coal scam-linked money laundering probe. The ED alleged that chief minister Mamata Banerjee interfered during the raids, removed digital devices and key documents with police support, and forced officials to terminate the searches without making any seizures. The agency also claimed that around Rs 20 crore in hawala funds from alleged coal pilferage were routed to I-PAC and has sought court protection, including safeguards against tampering with seized data and relief from FIRs filed against its officials.
