Navi Mumbai: Compassion isn’t a word Reuben Philip takes lightly. He owes his life to a stranger’s act of love as he lay beside his dying mother in a Bhandup slum 26 years ago. The mother had just one request: take the child; there was no one else to care for him. The man, pastor K M Philip, picked up the sickly nine-month-old, rushed him to hospital and soon took on the role of a father. Reuben (27) was the pastor’s first rescue and it led to many more by his group, Social and Evangelical Association for Love (SEAL), which marked its 26th foundation day on Saturday.“Had pastor Philip not visited the slum that day and noticed my mother, I don’t think I would have been here today. Compassion saved my life that day,” said Reuben, who was raised by the SEAL family. He completed a diploma course after Class 12 and now helps with administrative work at SEAL’s Panvel shelter that houses 370 inmates. Pastor Philip said it was a chance visit to the slum during a short trip to the city that changed the course of his and others’ lives. “I was scheduled to return to my hometown in Kerala shortly when I picked up Reuben. I had to extend my stay. One thing led to another, and we kept moving ahead, one rescue after another, and I settled down in Navi Mumbai permanently.” Abraham Mathai, former vice-chairperson of the state minorities commission and founder of NGO Harmony Foundation, who attended SEAL’s celebrations, said the group has also been responsible for nearly 700 reunifications of homeless, destitute and lost people with their families. IAS officer Siddharth Ramkumar, entrepreneur Meena Pathak, CEO of PixieStays Nisha Koul, and former actor-turned-sanyasi Mamta Kulkarni were among those who attended the celebrations. Kulkarni’s elder sister, Mithila Kulkarni, had lived at the shelter for a few years till her death in 2023. She recently visited the ashram to express her gratitude to the caregivers. On Saturday, she reiterated that she was “eternally grateful”. Asked about his future plans, the pastor said, “Our plan is to continue rescuing homeless people and ensure that govt also gets fully involved in this work. It is unjust if people simply die on roads for want of basic medical care.”

Mumbai’s Central Railway derails ticket fraudsters, recovers Rs 40 crore in 7 months | Mumbai News


Mumbai: Between April and Oct, ticket-checking teams of Central Railway (CR) identified and penalised 9.6 lakh cases of irregular travel, recovering penalties totalling Rs 40 crore. These efforts covered both Mail and Express trains as well as suburban services, including AC and non-AC locals.This move came after a concerted effort to curb fraudulent ticketing and ensure a fair travel experience for passengers. Western Railway (WR) and CR have intensified their vigilance and enforcement measures across their networks. During Oct and Nov, WR was proactive in identifying and addressing cases of ticket fraud.In CR, AC locals accounted for 71,045 cases with a penalty of Rs 2.2 crore, first-class coaches had 91,837 cases with Rs 2.9 crore in penalties, second-class coaches saw 698,248 cases with Rs 33.6 crore in penalties, differences in fares in Mail & Express trains resulted in 13,301 cases with Rs 71 lakh in penalties, and unbooked luggage accounted for 88,713 cases with Rs 98 lakh in penalties.In Oct alone, CR recorded 1.3 lakh cases of irregular travel, realising Rs 6.1 crore in penalties, said CR chief spokesperson Swapnil Nila.To further bolster enforcement on AC suburban services, CR introduced a dedicated AC local ticket-checking squad in the Mumbai division, which operates 1,810 services daily, including 80 AC locals. This squad, supported by a 24/7 WhatsApp complaint number, was instrumental in recovering an average of Rs 1.1 lakh daily from unauthorised travellers.WR’s vigilance efforts led to the detection of four significant fraud cases involving forged mobile tickets, fake tatkal reserved tickets, and misuse of concessions. In the first case, ticket checker Pradeep Kumar uncovered a digitally altered Rs 15 ticket in an AC suburban local, leading to the detention of the passenger, said WR chief spokesperson Vineet Abhishek. “Similarly, ticket checker Mohammad Zahid Qureshi identified two passengers misusing the Handicapped (HP) quota on a long-distance train, resulting in their deboarding. Qureshi, alongside another checker, Abdul Aziz, also detected a fake tatkal reserved ticket purchased from an unauthorised agent. Lastly, ticket checker Sai Prasad discovered a tampered mobile ticket in an AC suburban local,” he said. All offenders were handed over to Govt Railway Police (GRP) for further action.

Earlier this year, Centre abolished the post of “advisor to administrator” and redesignated it as “chief secretary”.

Non-BJP parties join hands to oppose Centre’s move

The Article 240 move has brought together non-BJP parties who see it as an attempt to “snatch” Chandigarh from Punjab.Punjab LoP Partap Singh Bajwa urged political parties in Punjab to unite against BJP-led Union govt’s “highly sensitive amendment”. “This Bill is a clear attempt to weaken Punjab’s historical, constitutional, and emotional claim over its own capital,” he said, accusing Centre of eroding Punjab’s rights “whether on Chandigarh, river waters, or Panjab University”.“BJP-led Centre’s antiPunjab agenda is now out in the open. Because Punjabis do not elect BJP, Centre seems intent on penalising state. This mindset is discriminatory, divisive, and completely unacceptable,” he asserted. Bajwa sought to remind Centre of the farmers’ movement and Panjab University Bachao Morcha as recent examples of Punjab’s collective strength.Punjab Congress president Amrinder Singh Raja Warring warned Centre against the proposed 131st Constitutional Amendment. Calling the move “totally uncalled for”, he expressed hope better sense would prevail in Centre and that it would refrain from legislating such a provision. “Chandigarh belongs to Punjab, and any attempt to snatch it away will have serious repercussions,” he cautioned, adding central govt should not make such a misadventure and must make necessary amendments in the proposed Bill. Senior Congress functionary Pargat Singh saw it as “part of a pattern”, and said, “The assault has been years in the making — pushing for a separate Haryana assembly inside Chandigarh, plotting to convert Panjab University into a central university, reducing Punjab-cadre officers in Chandigarh administration, dissolving Panjab University’s elected senate, and now using Article 240 to turn Chandigarh into a regular UT, completely severed from Punjab. It’s a blatant, unconstitutional attack on Punjab’s capital and federal rights.”Rajya Sabha MP Vikramjit Singh Sahney stressed Punjab’s claim on Chandigarh had historical significance as it became Punjab’s capital after Partition when Lahore went to Pakistan. Following the 1966 Punjab Reorganisation, the city became the shared capital of Punjab and Haryana and, under multiple accords, Centre promised to transfer Chandigarh to Punjab. Sahney urged all MPs from Punjab to immediately meet the Union home minister.

Bangladesh have unveiled their squad for the first two T20Is against Ireland, handing wicketkeeper-batter Mahidul Islam Ankon his maiden call-up in the shortest format. The 15-member squad, led by Litton Das, also sees the return of all-rounder Mohammad Saifuddin, while a couple of regular faces miss out. The three-match series will take place in Chattogram on November 27, 29 and December 2.

Ankon’s steady rise across formats has finally earned him a place in Bangladesh’s T20I setup. Another notable inclusion is Saifuddin, who returns to the squad after missing the West Indies series. His absence on that tour was largely due to the return of the regular captain, but selectors have reposed faith in Saifuddin’s death-overs skills and his utility as a lower-order hitter.

However, Taskin Ahmed and Shamim Hossain have been omitted from the squad. Taskin is believed to have been rested as he continues to manage his workload ahead of a busy international calendar, whereas Shamim’s inconsistent run with the bat appears to have worked against him.

The selectors have instead opted for a mix of pace options, including Mustafizur Rahman, Shoriful Islam, Tanzim Hasan Sakib, and the returning Saifuddin — giving the management multiple combinations to explore.

NEW DELHI: For the first time, a five-judge bench of the Supreme Court in a matter relating to interpretation of constitutional provisions abjured citing rulings of Supreme Courts of foreign countries to buttress their logic and referred only to the SC’s past judgments while penning its opinion on the Presidential Reference.CJI B R Gavai, who led the five-judge bench also comprising Justices Surya Kant, Vikram Nath, P S Narasimha and A S Chandurkar, said the bench wanted to speak in one voice and support its opinion with ‘swadeshi’ interpretation of constitutional provisions relating to the power and functions of the President and governors with regard to bills passed by assemblies.Another five-judge bench on Wednesday pronounced a judgment on promotions in judicial services without any of the judges taking credit for authorship. This trend of speaking in one voice, without any single judge taking credit for authoring the judgment, started with Ayodhya verdict. A five-judge bench led by then CJI Ranjan Gogoi didn’t have the author’s name.For the last six months, Justice Narasimha, since he started presiding over benches, has also rendered judgments without taking authorship credit and passing the verdicts as that of the bench. However, his bench colleague has been persuaded to take credit for judgments authored by him. It is likely that Justice Narasimha could have suggested an unanimous yet anonymous opinion by the five-judge bench on the reference.In the presidential reference opinion, the five-judge bench explained why it did not want to be influenced by foreign judgments. The SC said, “Copious written submissions and extensive arguments have been employed by counsel to underscore the functioning of the Westminster parliamentary model and its workings in the UK. They sought to draw parallels on the discretionary powers of the Crown and the limitations thereon.It added, “This court believes that our constitutional truth does not lay in either of these extremes but is grounded in the way we have successfully, and if we may add, proudly, worked our Constitution over three quarters of a century. While our constitutional text may have been inspired by comparative outlook, its interpretation and working, we believe, is truly swadeshi.”It explained how the working of India’s constitutional federal democracy was different from that of the UK and the US. “Unlike the English experience of an unwritten constitution, we have a written text. English constitutional law did not have to grapple with vital questions of federalism and an inherently diverse country,” it said. “The American experience is different due to the strict separation of powers between executive and legislature, necessitating the presidential veto. Indian constitutionalism has evolved to a parliamentary model where legislative agenda, business and enactment is overwhelmingly executed at the behest of the executive,” it said.

NEW DELHI: On his last day in office, CJI Bhushan Ramakrishna Gavai, the second from Dalit community to head the judiciary, said it is worrisome that caste is being weaponised by the socially and economically uplifted among SC/ST communities to corner a major portion of reservation in jobs.CJI Gavai also expressed concern over the spiraling social tendency to indulge in hate speech and said it is for Parliament to debate and, if needed, legislate new norms and mechanisms to curb the phenomenon. Reasonable restrictions on free speech under the Constitution appear inadequate to deal with rampant hate speech on social media. “Personally, I think that some sort of regulatory mechanism needs to be put in place,” the CJI remarked.Speaking to TOI, CJI Gavai said it is high time that Centre and the states sub-categorised SC/ST communities to enable those who continue to be socially, economically and educationally backward among these communities to reap the benefits of quota in govt jobs.As regards the verdict of a seven-judge bench headed by him that had permitted states to sub-categorise castes within SC communities based on socio-economic backwardness and the degree of under-representation in govt jobs, ensuring that the larger pie of quota in jobs went to the most backward, the CJI said that despite criticism from his own community, he strongly feels that the ‘creamy layer’ among SC/ST communities must give way to the deprived among these communities.Asked about the best and worst moments in his tenure as CJI, he said that while the judgment against bulldozer justice was the most satisfying one he had delivered, the way Justice Ujjal Bhuyan criticised his majority view in a recent verdict that overturned the earlier SC verdict on Bills passed by Assemblies marked a low for him. “He could have criticised my decision. But he was personal in his criticism. That left a bad taste,” the CJI said.Asked about the meagre representation of women in Supreme Court, the CJI said this is mainly on account of very few women judges at present finding a place among those in the zone of consideration. “This is because the selection of women judges for HCs picked up late, and I’m sure that in another five years, there will be many women HC judges in the zone of consideration for elevation to the apex court.”Given the option to choose between the Collegium system and one akin to the quashed National Judicial Appointments Commission (NJAC) which was put in place unanimously by Parliament, the CJI said the present system (Collegium) has worked well, especially since the Collegium started interacting with the recommended persons individually to test their suitability.On the pendency of more than five crore cases in trial courts, he said the strength of trial court judges (around 21,000 at present) needs to be increased in a phased yet continuous manner.Among the important judgments penned by him, the series of rulings that strengthened the protection of environment, ecology and forests are closest to his heart. The unanimous verdict in the Presidential Reference, the one for sub-categorisation of SC/STs and the striking down of Tribunal Reforms Act, all of which required long hours of deliberation, too figured among the favourite judgments of CJI Gavai.

NEW DELHI: Government is looking at a technology-based solution to curb the growing menace of two-wheeler riders using mobile phone handsets while driving or performing stunts, which contribute to road crashes. The plan involves installing touch or pressure sensors on both handlebars of two-wheelers so that if the rider’s hands are off the handle/s for more than 7-8 seconds, the vehicle would automatically begin to de-accelerate, forcing the person to ride properly.TOI has learned that the plan to use technology to correct rider behaviour was discussed at length at a meeting of transport ministry officials with vehicle manufacturers recently. Officials believe that such a mechanism could significantly reduce distracted riding, particularly the practice of holding a mobile phone in one hand while navigating traffic with the other, as well as performance of stunts.Many riders continue to flout basic safety norms despite penalties under the Motor Vehicles Act. “If the vehicle itself can sense unsafe behaviour and respond, it will deter risky behaviour without requiring constant policing,” said an official.Alongside handlebar sensors, manufacturers have been urged to explore the feasibility of providing leg guards on two-wheelers. This feature can reduce the severity of lower-limb injuries, which are among the most common in motorcycle crashes. While leg guards were more common in older models, modern two-wheelers do not have them.Government data shows there has been a steep rise in the number of two-wheeler deaths – from 69,385 in 2021 to 77,539 in 2023, nearly 45% of all road deaths. Two-wheeler riders top both as victims and cause of road fatalities. According to the road transport ministry’s report, two-wheeler riders had the highest share of road deaths in 2023 while 48,181 people were killed in accidents caused by them.

Bengaluru shocker: Pilot ‘sexually assaults’ cabin crew member at hotel; booked | Hyderabad News


HYDERABAD: A case has been filed against the pilot of a chartered flight for allegedly sexually assaulting a 26-year-old cabin crew member at a hotel in Bengaluru, police said on Sunday.Although the incident took place in Bengaluru on November 18, the victim lodged a complaint at Begumpet Police Station in the city, leading to the registration of a ‘Zero FIR’ under relevant sections of the BNS, officials added.“After returning to Hyderabad, the crew member reported the incident here and we registered a case and it was transferred to Halasuru police station in Bengaluru.
