Passport deposit as bail clause needs proof of flight risk: High court

CHANDIGARH: Punjab and Haryana high court has ruled that the authority vested in a criminal court to impose the condition of ‘deposit of passport’ ought not to be exercised in a “rote or automatic manner”, and such bail conditions must not unduly curtail personal liberty.HC was of the view that the condition for depositing one’s passport must be supported by specific material that points to a genuine flight risk. “It must be acknowledged that passport is not merely a travel document, but is often used as proof of nationality and identity. An order of deposit of passport as a pre-condition for bail is justifiable only on the basis of objective factors indicating a clear and imminent threat to the administration of justice, and must not be employed as a punitive measure against an undertrial accused, who is presumed innocent until proven guilty,” the bench of Justice Sumeet Goel held while deciding a criminal revision petition filed by Ram Lubhaya and others, who challenged a Nov 22, 2019, order of the additional sessions judge, Jalandhar.. HC was also of the view that it is not desirable to lay down any “straitjacket formulation” in this regard. To do so would be to crystallise into a rigid definition a judicial discretion, which even the legitimate has, for the best of all reasons, left undetermined. “Any attempt in this regard would be, to say the least, a quixotic endeavour. Circumstantial flexibility, one additional or different fact, may make a sea of difference between conclusions in two cases. Such exercise would thus, indubitably, be dependent upon the factual matrix of the particular case which the court is seisin of, since every case has its own peculiar factual conspectus. Such judicial discretion, but of course, ought to be exercised in accordance with the principles of justice, equity, and good conscience,” the court held.While the Jalandhar sessions court had granted anticipatory bail to the petitioners in a criminal case, involving charges of causing hurt and wrongful confinement, it directed them to deposit their passports before the trial magistrate. In their plea before HC, the petitioners argued that they were summoned only for comparatively less severe offences and there was no material on record to show they were a flight risk. “The condition was arbitrary, excessive, and imposed without justification. Passports are essential identity and travel documents, and their seizure caused undue hardship,” the petitioners argued.After hearing the matter, HC set aside the condition requiring the petitioners to deposit their passports, holding it to be unsupported by facts.

Mumbai: FIR filed against 72-year-old biker for rash driving and injuring two | Mumbai News


Mumbai: Police registered an FIR against a 72-year-old motorist for driving rashly, resulting in a pile up of 15 vehicles and leaving two persons injured. The incident occurred on Saturday around 3.10 pm near Tata Power, police said. The two injured were rushed to a hospital in Powai for treatment. One of them had suffered injuries to his back, head and shoulder. The other suffered injuries to his back and left leg.

Mumbai: Court grants dentist bail in trafficking case, says she intended to care for child | Mumbai News


Mumbai: Observing that she intended to take care of the child, a sessions court on Monday granted bail to Dr Reshmi Banerji, a 43-year-old dentist and medical college professor from West Bengal, who was arrested in connection with an alleged interstate child trafficking racket in April this year. After a grandfather in Mumbai complained to police about his missing grandson, police allegedly found that his son-in-law had remarried and sold the toddler to two persons who in turn passed on the child. The police eventually traced the child to the doctor’s residence. “In the present case, the charge-sheet has been filed. The…accused being a medical officer has not committed any injuries to the child. The accused is not a habitual offender,” the judge said.The matter originated from a missing person’s complaint filed by one Amar Sardar at the Wadala police station in 2024. Sardar reported that his son-in-law, Ganesh Purvaiyya, and his grandson had disappeared. Police investigation eventually tracked Purvaiyya to Andheri, where he allegedly confessed to selling his own son, to a middleman. The trail led authorities across state lines to Uttarpara, West Bengal, where Banerji was found with the boy. The defence submitted that while Banerji had prepared a birth certificate for the child, she did so out of a desire to provide the boy with a stable home, education, and a “good life”, believing him to be an orphan. It was also submitted that she was likely misled by the actual traffickers and was not part of any criminal conspiracy.Although the child had old marks on his body, court noted they were not fresh injuries and there was no evidence the doctor had harmed the child. The victim child remains in the care of the Aasha Sadan Rescue Home.

Notably, this is the third time that the CKP division has announced the cancellation of trains in quick succession.The CKP division attributed the cancellation to the frequent movement of elephants on three different sections under its limits.Seven MEMU & 1 passenger train cancelled: RlysCurrently, the Rourkela-Chakradharpur, Rourkela-Jharsuguda, and Rourkela-Nuagaon sections are affected by the frequent movement of elephants, prompting officials to announce the cancellation of seven MEMU and one passenger train on the up and down routes.The railway informed that Tata-Barbil-Tata MEMU (68125/68126), Tata-GuaTata MEMU (68019/68020), Chakradharpur-Rourkela Chakradharpur MEMU (68025/68026), Tata-Rourkela-Tata MEMU (68043/ 68044), Hatia-Jharsuguda Hatia MEMU (18175/18176), Rourkela-Jharsuguda Rourkela MEMU (68029/ 68030), Chakradharpur-Tata-Kharagpur-Chakradhar pur MEMU (68010/68009/ 68066), besides Birmitrapur-Barsuan-Birmitrapur passenger (58151/58152), have been cancelled.Earlier, the divisional railway cancelled five passenger trains on December 18 and 19, and then on December 20-21, four trains were cancelled on the same route. Now, the cancellation has been extended for the third consecutive time. Notably, the movement of elephants has not only increased on the tracks in the Chakradharpur division but also in villages near the tracks.Earlier on Friday, a villager was trampled to death in the Manoharpur block of the West Singhbhum district.Railway officials have stated that the back-to-back cancellation of trains is driven by their decision not to take any chances regarding the safety of the elephants. The senior divisional commercial manager of Chakradharpur, Aditya Choudhary, said that the long-distance trains moving on the Howrah-Mumbai route are taking necessary precautions on the identified route.“Along with the trackclearance teams doing their job, the pilots of the longdistance trains have been categorically asked to follow the standard operating procedures while moving through the identified sections,” Choudhary said.

Maharashtra records 1% drop in fatalities in first 11 months of 2025, Pune expressway sees 26% drop | Mumbai News


Mumbai: As per transport department statistics released on Monday, fatalities on state roads and highways dropped between Jan and Nov this year compared with the same period last year. On state roads, deaths fell from 14,185 between Jan and Nov 2024 to 14,066 in the first 11 months of 2025, a decrease of 119 fatalities, or around 1%, said a senior transport official.On the Pune expressway, fatalities declined by 26%, from 82 deaths in 66 crashes in 2024 to 61 deaths in 54 crashes this year. “We have undertaken several preventive measures including enforcement and penalties for offenders which has helped us curb the crash rate on Pune expressway and the rest of the state,” said additional transport commissioner Bharat Kalaskar.The district-wise data showed a drop of 21% in road fatalities in Nagpur, 20% in Palghar, 17% drop in Amravati and 15% dip in Pune, 14% drop in Dhule 12% in Sambhaji Nagar. “We plan to curb crashes by 50% by 2030,” he added, while appealing to citizens to follow traffic rules in the interest of road safety.

BOKARO: In a shocking incident, two men allegedly poured hot oil over a woman when she resisted their attempt to molest her at Ledha village in Jharkhand’s Giridih district Sunday. The woman suffered severe injuries and has been admitted to sadar hospitals.“One accused, Uday Choudhary, has been arrested, and efforts are on to arrest the other, Manish Choudhary,” said officer in-charge of Mufassil police station Shyam Kishore Mahto. An FIR has been lodged, he added.In her statement, the woman alleged that she was frying snacks at her shop when the men from a village turned up and started harassing her. When she resisted, they poured boiling oil on her and fled. Locals rushed her to the hospital. “The men have a history of misconduct and strict action must be taken against them,” said former village mukhiya Rajesh Verma.

PUNE: The fate of 57 local bodies in Maharashtra – 39 won by Mahayuti, 17 by MVA, and one by others – awaits SC’s verdict on Jan 21 as these are among the 288 municipal councils and nagar panchayats where the combined quota for scheduled castes, scheduled tribes and backward classes exceeds 50%.Acting on several petitions challenging the breach of quota limit, the apex court on Nov 29 said the election to these 57 seats would be subject to its final order. The verdict will also impact the results for the councillor posts in these civic bodies.“While the results were declared, those will depend on the final order,” an official from the state election commission (SEC) said Monday.Despite a decisive lead, Mahayuti will have to wait for clarity on 39 of its victories (BJP: 30, Shiv Sena: five, NCP: four). The situation is no different for MVA’s 17 wins (Congress: 11, Shiv Sena-UBT: two, NCP-SP: four). A senior BJP politician said, “The mandate clearly favours Mahayuti, but we will respect the Supreme Court’s decision.”“Nearly two-fifths of our victories are under scrutiny. These reflect people’s mandate at the grassroots, and we hope the court ensures stability and does not unsettle elected bodies,” a Congress member said.Of Mahayuti’s tally, the 39 local bodies that breached the 50% quota mark make up nearly 18.8% of its total wins. For MVA, the 17 bodies constitute about 38.6% of its victories.Of the 40 municipal councils, eight are in Nagpur district followed by seven in Chandrapur and five in Nashik.
