Plea in SC challenges gender bias in Parsi interfaith marriages

NEW DELHI: Supreme Court Monday sought the Nagpur Parsi panchayat’s response on a Parsi woman’s petition challenging the constitutional validity of the religious custom which excommunicated her for marrying a non-Parsi man. She termed the custom gender discriminatory as the rule does not apply to a Parsi man who marries a non-Parsi woman.Appearing for Dina Budhraja, senior advocate Shyam Divan told the SC that Rule 5(2) of the Nagpur Parsi Panchayat constitution violated Articles 21, 21 and 25 of the Constitution as it discriminated against women by subjecting them to exclusion, denial of religious access, and loss of identity for marrying a non-Parsi, while Parsi men suffered no such disability.A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and Vipul M Pancholi issued notices to the Nagpur Parsi Panchayat, Union govt and ministry of minority affairs and said it would examine what interim relief could be granted to the petitioner.The 43-year-old petitioner said the discriminatory practice under Rules 5(2) and 5(3) was explicit. “A Parsi man who marries a non-Parsi woman retains his identity and access to religious institutions, whereas a Parsi woman is stripped of both. The classification is founded solely on gender and fails the test of reasonable classification under Article 14,” she said in her petition.Budhraja, who married a Hindu man in 2009 and has a son and daughter, said she has not renounced her religion. “Despite continuing to profess and practice Zoroastrian faith, petitioner has been treated as having ceased to be a Parsi solely by virtue of her marriage with a Hindu man, by virtue of Rule 5(2),” her petition said. “Several other Parsi panchayats, including those in Delhi and Kolkata, do not subscribe to such discriminatory practices and treat men and women equally. The practice followed by the Nagpur Parsi Panchayat is, therefore, neither uniform nor essential to the Zoroastrian faith,” Budhraja stated in her petition.

BAREILLY: A one-month-old girl died allegedly due to starvation and illness after her jobless parents left her and two other siblings alone at home and went out to beg on Friday. The family lives in Qila Cantonment area of Bareilly.The child’s father, Mohd Shadab, has been living with his family in a rented house for the past four months. According to local residents, Shadab was involved in the manjha (kite string) trade and lost his job during the Covid-19 pandemic, but could not secure a job after that. Though he got some temporary assistance from people, he was eventually forced into begging to sustain his family. Around 11 am on Friday, Shadab and his wife, Hina, left their three children, one aged one month and the other two kids, aged 1year-and-six months and four years, at home and went out to seek alms. When they returned around 6 pm, they found their one-month-old daughter unresponsive.“When the family started preparations to bury the body, police were alerted around 10 pm, said Qila SHO Subash Kumar. A police team arrived and took custody of the body and sent it for postmortem. The body was handed over to the family after postmortem examination. “The autopsy report cited illness and infection as the cause of death. However, locals claimed that the infant died due to starvation,” SHO Kumar told TOI on Sunday. TOI on Sunday reached Shadab’s house, but he had vacated the room after he failed to pay the rent. TOI tried to contact him, but he was unreachable. Neighbours said they were not aware of his whereabouts. A local resident said that this is not the first such tragedy in the family. The couple had earlier lost another child, aged six months, under similar distressing circumstances.

NEW DELHI: The three-day 12th steering committee meeting of the Global Operational Network of Anti-Corruption Law Enforcement Authorities (GlobE Network), which comprises members of investigative agencies from 135 countries, began in the national capital on Monday. It will deliberate on the network’s strategic direction, operational priorities and evolving frameworks for international cooperation.Directors of CBI and ED played host at the meeting, attended by members of the 15-nation steering committee of GlobE secretariat under the UN Office on Drugs and Crime. The global platform is a specialised anti-corruption law enforcement authority, established under the Riyadh initiative during Saudi Arabia’s G20 presidency.Delivering the welcome address, ED director Rahul Navin said ED has restituted assets worth approximately $5.6 billion, including in corruption cases, a significant portion of which was achieved in the past couple of years. The GlobE Network complements formal legal assistance mechanisms by enabling faster, more flexible and direct agency-to-agency engagement. The 15 nations currently serving on GlobE steering committee are India, Brazil, China, Russia, Spain, Italy, Saudi Arabia, South Africa, South Korea, UAE, Azerbaijan, Ethiopia, Grenada, Nigeria and Romania.

NEW DELHI: Supreme Court Monday criticised what it called a perceptible reluctance among probe agencies to proceed against Anil Ambani-led ADAG group companies accused of siphoning Rs 40,000 crore from bank loans, and directed CBI and ED to carry out an expeditious and coordinated inquiry against the ADAG entities, their directors and officials.A bench of CJI Surya Kant, Justices Joymalya Bagchi and Vipul M Pancholi said, “The conduct of the investigating agencies has reflected a degree of reluctance. The investigation carried out by the probe agencies must be transparent, fair and prompt to inspire confidence not only in the court but also among all stakeholders and the public.”File fresh status reports of ADAG grp case in 4 wks: SC to CBI, EDWhen the bench said though the irregularities in Anil Ambani-led ADAG group loan fraud probe were flagged much earlier by Sebi and CBI’s Aug 2025 FIR dealt with a small part of the fraud, Solicitor General Tushar Mehta, appearing for CBI and ED, assured the court that the views of the court would be conveyed by him personally to the agencies in a “much harsher” manner.SC asked the agencies to file fresh status reports in four weeks.Mehta informed the court that ED has constituted SIT as directed by the SC and the CBI has so far registered eight separate cases involving alleged siphoning off nearly Rs 41,000 crore from bank loans. Four top officials of ADAG group have been arrested so far, Mehta said. He said CBI is taking help of financial experts to unravel the complex routing and re-routing of money.He said ED has written a letter to banks and financial institutions for prompt furnishing of information relating to sanctioning of loans and the due diligence followed prior to disbursement of the loan amounts. He said the ED has also requested them to act against errant officials under the banking laws and regulations.On his request, the bench directed all financial and other institutions to promptly furnish the information required by the probe agencies. “Apart from the ADAG group and its officials, those involved in the irregular sanction of loans and playing with public money should also be proceeded against,” the bench said.For Anil Ambani, who has already given an undertaking to the court not to leave India without SC’s prior permission, senior advocate Mukul Rohatgi said the ADAG group is ready to discuss with the banks and financial institutions for settlement of the dues, but no one is coming forward because of the pendency of the PIL by former bureaucrat E A S Sarma.Mehta said the settlement of dues could absolve the ADAG group of civil liabilities, but the criminal acts require to be thoroughly investigated and taken to their logical end. The bench brushed aside Rohatgi’s request for directions to the banks to discuss settlement of dues with ADAG group. For the PIL petitioner, advocate Prashant Bhushan said that Sebi had given a detailed report about the financial fraud indulged in by ADAG group entities and yet the probe agencies did nothing till the SC issued notices to them.The petition, filed through advocate Pranav Sachdeva, alleged that three of the ADAG companies – Reliance Communications (RCOM), Reliance Infratel (RITL) and Reliance Telecom (RTL) – cumulatively received loans to the tune of Rs 31,850 crore from a consortium of public sector banks led by SBI between 2013-17.Petitioner said various documents revealed alleged involvement of ADAG companies in “large-scale diversion of funds, roundtripping, misuse of external commercial borrowings, fabrication of accounting entries, operation of shell entities, and a complete disregard for the public money.”
